Neighbor's dog killed my dog and neighbor refuses to do anything?
Let me be clear – it’s my 75 year old mother in law’s dog… my husband and I were taking care of him while my grandmother is away on vacation. This afternoon, I got in from work and he needed out, so I put him on a leash and took him out… our neighbors have a history of being really lax with their dogs and not really ever watching them. My mother in law’s dog was such a sweet, cute little Welsh Corgi – Aus. Shepherd mix named Charlie (that we got for her from the local humane society), couldn’t stand more than a foot tall or so… and our neighbor’s dog is a HUGE English Mastiff… they’re always barking at each other through the fence, but we never thought anything of it.
Anyway, today, the neighbors had left their gate open and when I took the dog out, here came the mastiff bolting towards us and barking viciously… at first I just kind of pulled Charlie close to me because I had always thought the mastiff was a really sweet dog (I gave her food every night through the fence, pet her, talked to her, etc). But the dog JUMPED on poor Charlie and went right for the throat. Charlie was defenseless and the mastiff was killing him, biting and biting at his neck…
at that point I was on the ground trying to wrestle the mastiff away. I was DRIPPING in blood, both my blood and the dog’s blood (the mastiff bit me repeatedly). then another neighbor from down the street who was putting up Christmas lights came over with a hammer and started to beat and beat the mastiff with the wooden part of the hammer to no avail… then my husband drove up and stopped his car in the middle of the street and jumped out to try to get the mastiff off. He got a HUGE gash on his arm from being bitten. we were all in the middle of the road, rolling around in the gravel, yelling and screaming (I was swearing like a sailor at the top of my lungs), beating the mastiff, who was intent on killing Charlie. the neighbor who was helping got knocked over by the mastiff and fell over and broke her wrist, but she kept trying to get the mastiff away. we were all dripping with dark dog blood, and then it was all over… charlie died right on top of me. he was ripped all open, blood and ravaged body parts everywhere, and even after he had died, that damn mastiff was still at his throat, shaking him and shaking him, and we still couldn’t get her off… we finally succeeded and we dragged charlie to the garage to make sure that he had died, and the mastiff charged after us and attacked his corpse over and over… it was so horrible … i could hardly watch =/
anyway, the neighbors whose dog this was weren’t at home while all this was happening… eventually they found out about it and they refuse to do anything. they’re telling the police I opened the gate and let the mastiff out! they won’t take any of the blame, won’t pay any of the medical expenses (we all went to the ER), won’t do ANYTHING! they won’t even answer our calls. the police here are incompetent pigs and don’t seem to care about any of this.
what the hell can i do about this horrible situation?
i’ve never dealt with ANYTHING like this before… I’m just so sad… he was such a sweet, happy dog and he died in my arms
Get a lawyer, give him all the details and let him handle it, and while he is handling it, do NOT speak to those neighbors about it at all… if they come to talk to you about it, simply refer them back to your lawyer and LET HIM HANDLE IT COMPLETELY!

you can sue about the dog attacking you and breaking leash law(both are serious crimes), husband, and neighbor but your mother in law is the only one who can do anything about her dog dieing. so sorry about that.

well you have 2 witnesses to tell the police and they retarded neighbors HAVE to do something!!! thier dang dog killed charlie!!! I would probally strangle them if they killed my dog. shes in the room with me. we just got her last march!!!! i

well first dont let them get u call cops right away have your nabor be the witness and press charges and they will get there do away and put tom sleep for being dangrous and prss charges all u can or call our local game the war or cal the humam sicty or your town shirff

That is a law suit!
There is the whole neighborhood knowing their habits and then there are three of you who saw the whole thing! I hope you have a police report from the whole thing and pictures from both your wounds and the picture of whatever was left of poor Charlie! Any judge in his right mind would see that you would NOT have opened the door. You should ask right away a policeman to check the type of gate lock the bastards have. If they knew they have a problem dog, they should have considered a better lock. The way a see it, it’s not the dog’s fault, because she’s an animal and that’s what they do. I am sure that she would be put to sleep, and I am sorry about it. If she would have had the better training. or any kind of training, actually…
Take them in court. They should pay the medical bills at least.
My son fell in the school gym and he needed a cat scan, which is very expensive. The Insurance company contacted me a couple of months ago to ask me if the injury was a result of an accident. Call the insurance and let them now of what happened. Usually they don’t like to pay for accidents that were not your doing, so they will try to be reimbursed by the guilty part. At least they would go after them.I am sorry, I do not know too many terms law related.
You could get media involved, too.
Make a trip to the Small Claim Court and see what you have to do; you would not need an attorney.
Another suggestion is the Animal Abuse Society, Animal Planet. Contact them and see what they advise you.
Don’t stop fighting for your rights; don’t let them get away with it!

I am a dog bit victim myself, and I think it’s a good idea to get a lawyer. If you and others were hurt in the processes of all this, then the situation needs to be addressed. Get a police report, call animal control and take everything to a lawyer. You can even call a local vet office or an animal shelter and ask for advise. My sister is a veterinarian and we have seen plenty of aggressive dogs. This sounds like it is the typical example of a normally sweet dog being unpredictable. I hate to say it, but there is no veterinarian, or animal control officer that I know of that wouldnt think this animal needs to be put down, even if she is normally sweet. She is not unpredictable and CANNOT be trusted around other animals, or especially small children. Best of luck to you, and I’m so sorry about your tragic loss.

Please, please, please get a lawyer and have him/he handle this situation; give him/her every bit of detail possible, and have him/her get in touch with all witnesses that were present during the incident; do not contact the dog owners, do not speak to them, refer them to your lawyer if you must. Do not let this event go unheard of and do not let your neighbors get away with their irresponsible, careless ways. If this has happened once thus far, I assure you that it will happen again to another dog, or to a cat or even a child.
I am terribly sorry for what happened, this is something that would have easily been prevented if your neighbors had been more responsible with their dog. I cannot imagine how horrible you may feel. Punishing the dog owners may not bring back Charlie, but it may bring him justice, and it could very well prevent further incidents from happening due to these people and their awful dog.
It is dog owners like that whose carelessness and stupidity label molosser and bully breeds with undeserved bad reputations and are at fault when the responsible dog owners are forced to pay the price of owning such a dog.
